House passes dangerous dog bill, AL

    After pushing for three years, the Alabama Humane Federation has finally gotten the House approval on a bill that would help protect people from being attacked by dogs.

    According to Escambia County Humane Society Director Renee Jones, State Sen. Pat Lindsey (D-Brewton) put in a special request to get the bill up for a vote on the last day of the regular session

    This bill establishes the procedure by which a dog can be declared dangerous and the owner held liable for any harmful actions of the dog.

    This legislation is not breed- specific and applies to the actual harm caused by the animal instead of the kind of dog it may be.

    ”We are very pleased that the legislators in Alabama have taken a stand in recognizing that the fighting of hogs and dogs in an arena for the purpose of profit and violent entertainment is cruel,” Jones said. “Pit bull breeds of dogs are the number one abused animal on the planet because of activities such as ‘catch pens' or ‘hog dog rodeos.'”

    The bill allows the owner of a dog accused of being dangerous due process and the right to a fair and impartial hearing in court.

    It also calls for containment and confinement regulations for dogs that have been declared dangerous by a judge.

    The bill states if a dog has been declared dangerous and when unprovoked shall attack, assault, wound or cause serious physical injury or kills a human being, the owner shall be guilty of a Class C Felony.

    “These events are no different than dog/dog fighting, and that has been a felony since 2000,” Jones said. “The new legislation puts the hog dog events in the same category by also making it a felony.”

    A dog may not be declared dangerous under this act if:

    € It attacks a person committing a willful trespass or other tort upon premises occupied by the owner of the dog with the intent to commit a crime.

    € When the dog is protecting a person from an unjustified attack.

    € When an injury to a domestic animal happened while the dog was working as a hunting dog, herding dog, or protecting itself or its kennel.

    “We would particularly like to thank Rep. Thomas Jackson and Sen. Lindsey for their support,” Jones said.

    The next step is to ask Gov. Bob Riley to sign the bill into law.

    This story is inaccurate.
    House Bill 86 which makes "Hog-Catchs" illegal passed, but the Dangerous Dog Bills(House Bill 27 and Senate Bill 82), have not passed.
