GA: Charges Dismissed Against Randall Thaxton

    Charges against a Union Hill man accused of raising pit bulls for dog fighting have been dismissed.

    Randall Thaxton, 46, was arrested in October 2008 by the Cherokee Sheriff's Office after a two-week joint investigation in Cherokee and Gilmer counties.

    He was arrested on seven counts of felony dog fighting, 10 counts of animal cruelty and one count of possession of marijuana.

    Investigators at the time of his arrest said dogs found at Thaxton's home had scars and other injuries that appeared to be the result of dog fighting.

    Ten dogs were seized as was a treadmill designed for dogs and breeding equipment.

    Thaxton's family denied his involvement in dog fighting, contending the pit bulls were raised for dog shows.

    In January, Thaxton was indicted by the Cherokee County grand jury on only the animal cruelty and drug charges.

    According to the indictment, Thaxton caused "unjustifiable physical pain" to American pit bull terriers. The juvenile dogs were found on collars and chains weighing between 4.6 and 8.8 pounds.

    District Attorney Garry Moss at the time of the indictment said he would not pursue the dog fighting charges.

    According to court records, a motion to suppress evidence gathered by investigators from Thaxton's home was granted on Thursday.

    Thaxton's attorney in the motion argued the search warrant was illegal as it wasn't supported by probable cause.

    Cherokee County Superior Court Judge Frank C. Mills III then dismissed the charges, according to the district attorney's office.

    Assistant District Attorney Patricia Hull declined to comment on the case.

    Mills and attorneys for Thaxton didn't return calls for comment by press time.

    Following his arrest and the seizure and euthanization of his dogs, Thaxton filed a lawsuit against the county government, which is pending.

    Dam Right Sue for your dogs man you have fought this shit for a long time every time and went I went to your house you was down and out you should sue for the dogs and pain and suffering that you and your family has been threw I was Happy when joe Called me and told me they droped charges

    they took al whites dogs they took Ray beaves dogs they took Joe Woodalls dogs and they took Randall thaxtons dog all in the same day its a dam shame the number of dogs that where put down for nothin here in Georgia

    Something needs to be done here. They canNOT keep getting away with this shit.
    Even if the government doesn't win in court, they still win overall cause the dogs are dead.

    GOod shit, I'm happy for the man. He wasn't as fortunate as joe to get his dogs back which is a shame. But atleast it aint another conviction

    the dogs were killed by a vet after being in Cherokee county care for 19mons. Randall and his family went though alot in the last 2 yrs...and they still lost there dogs,some were 10-12 years old They were family to Randall and Sheila,to all of us really....stand up now people they are coming for anyone with a pit bull and hopefully no more APBT will have to die....we wish Randall and Sheila the best.hope the get them in the end!!!!!!:confused:

    Good luck on the law suit... It would be great for pitbull owners if Thaxton wins his suit.

    i know its a little off topic, but how is floyd & guy doin in theyre suit?

    Oh dont worry hsus is on the agenda...we will get them all for what they have done..norrad and ass. are that list...we are just starting with the dogs....Randall went though alot of emotional damage too...he had to wear a ankle monitor for the last 2 yrs..his wife couldnt come home because she had two small dogs which he coulndt be around, had to have supervised visit with his own grandson...lots of crap but we will getem all!!!!!:mad:

    I'm not in Ga. anymore, but I would be more than willing to come up there and help in any way possible! This is getting out of control, and something has got to give! Stand up for what you believe in people....before it's too late. Tracey, my prayers are with you, Joe, Randall and everyone else who's been through/going through this BS.
