    Animal Welfare act of 1976
    <!--end heading_1-->[font=arial, helvetica, sans-serif]<!--begin text_1-->On July 22, 1976, the President of the United States signed into law something called "The Animal Welfare Act of 1975". Much of the new law concerns itself with humane treatment of animal in transit from one place to another and amendments to previously pased legislation concerning farm animals and laboratory animals.[/font]

    Section 26 of The Animal Welfare Act prohibits animal fighting ventures and reads as follows:-

    (a) It shall be unlawful for any person to knowingly sponsor, or exhibit an animal in any animal fighting venture to which any animal was moved in interstate or foreign commerce.

    (b) It shall be unlawful for any person to sell, buy, transport or eliver to anothe person or receive from another person for purposes of transportations, in interstate or foreign commerce any dog or other animal for purposes of having the dog or other animal participate in an animal fighting venture.

    Paragraph (d) sets forth the penalty for violating paragraphs a-b-c, ,000 fine, imprisonment of not more than one year or both.

    Paragraph (e) authorized in government to investigate any alleged violation of this law, and authorizing any such person to obtain the assistance of the FBI, the Department of the Treasury, and other law enforcement agencies of either the United States, state and local government agencies. It further provides that a warrant may be issued by any Judge or U. S. Commissioner, to search for and seize any animal which there is PROBABLE CAUSE to believe was involved in any violation of this law.

    What does it all mean?

    There have always been State and Local ordinances which make fighting dogs illegal. In some States, while the statutes do not specifically mention dog fighting, per se, it does fall under the existing gambling laws or violate one or more of the agriculture ordinances. So what makes this law different from the local laws...

    To begin with it provides for higher penalties. It also authorizes the federal government with it's more sophisticated investigating procedures to aid in any such investigation.

    However, what I believe is the most important aspect of the new law "That a warrant may be issued, to search for and seize any animal in which there is PROBABLE CAUSE to believe was involved in a dog fight."

    Prior to this law, in most states, dog fighting was a misdemeanor and as such, the violation had to be witnessed by the arresting officer. Now, under the new law, if an investigating body can convince a judge that there is a PROBABLE CAUSE that a fight took place, the judge can issue a warrant to search for evidence and take possession of any animal SUSPECTED of havving been in a fight.

    The Federal Governement does not pass laws that can be passed by any single state, therefore, the Animal Welfare Act, to be effective, must by necessity involve more than one state.

    Interstate is defined in the law as follows:


    Any movement between any place in a State to any place in another State or between places in the same State through another State. So far the Federal law to be put into effective practice, it must be proven tht the dogs had crossed a State line.

    Well, that is the law, be governed accordingly.

    It is a perfect example of the fact that if you repeat lies, half truths and utter nonsense often enough, you will get other people, including the Congress of the United States, to believe it.
