    County to adopt new dog ordinance

    Owners of dangerous dogs will face tough restrictions under a revised animal control ordinance the Floyd County Commission is poised to adopt.

    For the first time, the ordinance will contain provisions for legally classifying a dog as dangerous, said Scotty Hancock, director of animal control and the county’s emergency management agency. The owner would then have to provide special housing, signage and insurance, in addition to registering the animal with the county.

    Hancock said the lack of a specific dangerous dog law came to a head recently when a German shepherd bit two people — including a 6-year-old who underwent surgery.

    “The owner didn’t want to give up the dog,” he said. “She finally did, but we didn’t really have an ordinance to back us up.”

    Another new provision would automatically classify as “vicious” any pit bull or pit bull mix. Vicious animals must be kept within a five-foot-tall fence and be muzzled and leashed when off the owner’s property.

    County Manager Kevin Poe said the local ordinance has not been updated in 20 years. A public hearing on the proposed amendment is scheduled for the board’s Sept. 12 meeting.

    “We want to make the ordinance more defensible in Magistrate Court and update it to reflect modern operations and new state laws,” Poe said.

    Most of the proposed changes are relatively minor and aimed at tightening loopholes, said Jason Sanker, an attorney with the county’s designated legal firm, Smith, Shaw and Maddox.

    Animal control officers will no longer have to abandon the chase if a loose animal runs onto private property, Sanker said, and it will be illegal for people to free animals trapped by the officers.

    The ordinance also defines “adequate” shade and shelter as a structure with a roof and the ability to keep a dog dry. The current ordinance does not define the term — an omission that has led to dismissals of animal cruelty charges in the past.

    Hancock said another change created a 72-hour waiting period before pets that are voluntarily surrendered by their owners can be adopted or killed. The move is a safeguard, he said, in case owners have second thoughts.
