The verdict is in!

    Yesterday was our court date over the shooting death of Miakoda by a neighbor when his dog attacked her/us while we were out walking.

    He was convicted on both misdemeanor charges, and although originally upset over the animal cruelty charge being changed from a felony to a misdemeanor, he was slapped with a little over $11,000 in fines so I'm happy. In addition to the fines, he was ordered to 300 hours of community service at our local animal control. And last but not least, he cannot own a dog for a 5 year period and has 72 hours to find a home for the new Boxer puppy his family recently acquired.

    Honestly, considering how things go in today's society, I am pleased with the outcome. Now I will be concentrating on our civil suit.

    Great News!! I am so happy that they banned him from owning another dog for 5 years and the $11,000 ought to make him think about the severity of all he caused.

    Keeping my fingers crossed for your Civil Suit.

    Yeah thats good Mia. I think he should have been drawn and quartered but thats just me. 11,000 bones is a shot in the pocket though! :) Hit em hard in the civil suit and good luck!

    That is damn good news! Good job in pursuing all of this. I am sure that he would have gotten off a lot better if you didn't work on all of this. I hope he learned his lesson.

    Ok, question here ... even if Mia wins everything, what if he doesn't have the means to pay? Or what if he just declares bankrupcy? I mean, we're all hooting & hollering here, but there is a very real chance Mia might not see one red cent out of the guy.

    But even still ... he DID have to go through all this so I hope he DID learn a lesson & even though you might not get anything out of it, I do hope you still pursue a civil suit Mia!

    Bankruptcy? Well, he just screwed his credit if he does, which hurts him worse. I believe that in filing bankruptcy, state will repossess (sp?) many of his luxury items (IE boat, sea doo, any extra vehicles, etc.) Mia ends up getting paid through state, and state taxes his @$$. Bankruptcy has changed over the past couple of years, and is not as easy of an out anymore (don't ask).

    We are hooting and hollering for 2 reasons:

    1. Even though no money in the world can bring a loved one back, even a dog, justice was served and Mia feels better about it.

    2. The courts looked past the whole APBT issue, and for once our breed won a case.


    With that said, congrats Mia! Now pursue that civil suit.

    I think that's awesome. If the fines were to the city, I don't think those are dismissable with bankruptcy. But I really don't know for sure. Either way its great. I just hope he takes his defeat like a man, and doesn't turn stalker.

    I forgot to ask. What happened to the attacking dog? Was he euthed?

    Yeah all he has to have is a house or some kind of insurance you can get him. Mia you have to sue him not only for personal gratifaction but if you dont make a statement then it will be open season on our breed. Get his ass......
