    OHIO SUPREME COURT
    reverses Tellings Appellate Court case!
    Amazingly, the Ohio Supreme Court
    has reversed the TELLINGS case
    decision from the Appellate Court--
    Apparently BSL in Ohio is politically correct....
    As many of us know, the Tellings case was one of the few
    BSL cases which actually was based upon FACTS--not hype.
    Although all evidence and studies show BSL does not work,
    apparently the Ohio Supreme Court ignored the factual
    evidence and claimed that dog warden Skeldon had
    better evidence than all of the experts on the trial record.
    Skeldon has been accused of animal abuse himself,
    so it comes as no surprise that he claims the world's
    record for having seized the most pitbull type dogs!
    Both the American Canine Foundation, Mr. Tellings
    and the ASPCA recently filed for
    reconsideration in the Ohio Supreme Court case.
    Upon reading the Ohio Supreme Court decision, one can
    easily see that the court agreed:
    1) pitbull dogs are not inherently dangerous
    2) pitbull dogs do not bite more often than other breeds
    Despite this finding, the court then ruled that pitbull dogs
    are presumed vicious by alleging that, according to
    dog warden Skeldon, criminals use the dogs, police shoot
    the dogs, etc etc.
    Even if such dogs were used by criminals, the proof has already shown that BSL does NOT stop
    such criminal activity. The proof is that BSL law has been in place for years but that such crimes have
    remained consistent.
    Let's face it--you cannot stop crime by making a dog type "bad" when you have criminals
    who will do what they wish no matter what laws are in place. Skeldon, apparently working with HSUS, has
    now announced that he will push for MANDATORY SPAY/NEUTER OF ALL PITBULL TYPE DOGS.
    San Francisco used SB861 on this issue which allows any city or county to SINGLE OUT
    ANY SPECIFIC BREED for mandatory altering. The federal judge in that case summarized the rational
    basis by claiming that "if there are less pitbull dogs then there will be fewer children killed by such dogs."
    If that isn't one of the most asinine statements ever made?!
    Clearly we can see that members of the judiciary are siding with animal extremists and are sympathetic to
    their agenda. We know that PETA calls for the extermination of all pitbull dogs, and even all homeless
    animals, claiming that "euthanasia" is preferable to saving them. When we see groups like PETA and HSUS
    consistently pushing for MANDATORY SPAY AND NEUTER, it is obvious that it is just a matter of time
    before it will be illegal to OWN a dog, buy a dog, or sell a dog. OWNERSHIP of property creates a
    DUE PROCESS issue. Without ownership, there is no due process
    (due process usually refers to the notice and opportuity to be heard)..... And that is why extremists do NOT
    want anyone to OWN animals---because they want NO DUE PROCESS RIGHTS for pet OWNERSHIP,
    since they believe animals are not to be "owned", "used", bought or sold as "commodities".....
    THE HSUS $$$$$ GAME---How they TAKE People's $$$$ to advance their own Animal rights Agenda

    That's right--HSUS was SO "concerned" about the fate of
    Michael Vick's dogs that HSUS sent out millions of emails
    begging for donations to help THEM care for Vick's dogs.
    Just one MAJOR problem that HSUS "forgot" to mention..............
    HSUS doesn't have custody of the dogs, and and HSUS got caught in a LIE.​
    CEO Pacelle posted on his "opposition" blog by calling 'critics'​
    greedy evil dog breeders, front men for the meat industry and probably dog fighters, etc.​
    BOTTOM LINE?
    Both HSUS and PETA operate by using the front of "saving animals" as a way to get $$$$.​
    But AFTER taking in everyone's $$$, BOTH groups advocate for the death ​
    of innocent pets, especially DOGS. ​
    Peta and HSUS are NOT interested in actually stopping dog fighting.​
    NO---it makes WAY too much $$$ for them when it happens!!​
    These groups are extremely clever, and good at marketing. They come up with​
    emotional ploys which appear to be focused on​
    saving, saving, saving certain animals. BUT when it comes to plain ole' dogs,​
    they push for not only killing them, but for altering every​
    single one without exception.​
    (HSUS hired a lobbyist to support MANDATORY ALTERING FOR ALL DOGS​
    AND ALL CATS IN CALIFORNIA THIS YEAR, FOR​
    AB1634--WHICH WILL RETURN IN JANUARY 2008, LEGISLATURE)​
    PETA even says you should alter your neighbor's dog!​
    It is not that difficult to figure out---you take a volatile subject​
    matter like "killing animals" and then you pretend you really are saving them. ​
    The reality is that this story makes money for them----the records of PETA ​
    clearly shows they do NOT spend money on "saving" animals.​
    Most of their profits are spent in marketing campaigns to snare unwary people into donating $$.
    Do you realize how many YOUNG people are DUPED
    into believing PETA?
    Did you know PETA has tons of websites, many of them aimed right at kids
    age 10 yrs and younger?
    Did you know PETA people tried to bomb the KFC in CHICO, CA?
    Do you think Peta functions like a cult by using brainwashing, repetition, peer pressure, and mob mentality????

    Remember, HSUS is under criminal investigation and ​
    cannot account for more than $30 MILLION after hurricane Katrina. ​
    WHEN ALL PEOPLE REALIZE THAT HSUS AND PETA ARE NOTHING​
    BUT MONEY MONGERS WHO TAKE MONEY 'DONATIONS' IN ORDER​
    TO FURTHER their agenda of making everyone a "vegan", ​
    releasing every animal into the "wild", ​
    and abolishing "pet" ownership completely. ​
    Don't believe a word these groups say.​
    They exist to suck the $$$ out of ordinary people
    so they can run their campaign against owning animals as pets. Do your research!!!! If you didn't know this, please tell a friend and pass it on.
    The time has come to stop this hogwash by making everyone aware!

    A very brief and therefore skeletal summary of the court's logic: the legislature can pass any law, provided that it does not infringe on a constitutional right. There is no constitutional right to own dogs.

    Because the court is not the legislature, a court only makes sure that the law has some rational relation to a legitimate governmental function, regardless of whether the court thinks that the legislature could have used different or better means to achieve the same intended result. That is the essence of the concurring opinion, which notes that, while the legislature made a stupid law, the courts cannot substitute their judgement for that of the legislature's.
