    We, the undersigned, oppose the proposal to
    ban Pit Bulls in NYC, and would like to see it defeated.
    NYC Councilman Peter Vallone is trying to ban pit bulls from city pet
    owners (by way of repealing a "state law prohibiting breed-specific
    legislation".)

    Why BSL is Unconstitutional

    Breed-specific legislation (BSL) is unconstitutional because it violates the 14th amendment of the constitution (commonly referred to as citizens’ civil liberties), particularly the equal protection and due process clauses. The 14th amendment states:



    No State shall…deprive any person of life, liberty, or property, without due process of law; nor deny to any person within its jurisdiction the equal protection of the laws.



    Our dogs are our property and they cannot be taken away from us legally unless it can be proven that they constitute a danger to the general public. Bully breeds and Rottweilers, breeds most often singled out for breed-specific legislation (BSL), have not been proven to be any more dangerous than any other breeds of dog. As such, BSL infringes on citizens’ equal protection rights.



    Further, because it is almost impossible to prove breed heredity, BSL also infringes on citizens’ due process rights. Every citizen has a right under the due process clause to attempt to affect the outcome of a municipal or state-imposed deprivation of property (in this case, citizens’ dogs). When BSL is imposed and the owner is penalized yet it cannot be determined that the dog is indeed the banned breed in question, the dog owner’s due process rights are infringed upon.



    Breed ban proponents and dog owners alike would do well to know these rights and to have a better understanding of why BSL is an infringement of them.

    The statment has been made that pit bulls are "often a weapon of choice of
    drug dealers and gangs seeking to intimidate and terrorize neighborhoods."
    Then target the gangs, drug dealers & other irresponsible owners, not the
    breed. Besides, criminals would just find another dog to use as
    intimidators.
    Councilman Vallone has said that the pit bulls' jaws "lock," which
    prevents people from defending themselves, their children or pets from
    being hurt. He should check his facts before opening his mouith.
    Fact: The infamous locking jaw is a myth. The American Pit Bull Terrier
    and related breeds are physiologically no different from any other breed
    of dog. All dogs are from the same species and none have locking jaws. Dr.
    I Lehr Brisbin of the University of Georgia states, "To the best of our
    knowledge, there are no published scientific studies that would allow any
    meaningful comparison to be made of the biting power of various breeds of
    dogs. All figures describing biting power in such terms can be traced to
    either unfounded rumor or, in some cases, to newspaper articles with no
    foundation in factual data." Furthermore, Dr. Brisbin states, "The few
    studies which have been conducted of the structure of the skulls,
    mandibles and teeth of pit bulls show that, in proportion to their size,
    their jaw structure and thus its inferred functional morphology, is no
    different than that of any breed of dog. There is absolutely no evidence
    for the existence of any kind of 'locking mechanism' unique to the
    structure of the jaw and/or teeth of the American Pit Bull Terrier."

    'Pit Bull Facts'

    A lot has been said about 'pit bulls'. That they are time bombs. That they
    were bred to fight. That they are unreliable.

    Before you make up your mind about whether or not a 'pit bull' ban is
    justified you owe it to the breeds affected to learn the truth.

    Fact: It is true that the 'pit bull' was originally bred to fight - other
    dogs. However the dogs lived at home as a family pet in the late 1800s and
    lived in the house with the wives and children of the men who fought their

    Howard (Father in Crossing Jordon - his Pit Shadow saved his life),

    Johnson, Mary Tyler Moore, Steve and Terrie Erwin (the Crocodile Hunter),
    Jack Johnson, Bill Berloni (Broadway show dog trainer who has said that
    the Pit is the breed of choice for training), Anthony Robbins, Molly

    We need to address the REAL issues here, not the myths that Councilman
    Vallone is trying to use to support his agenda. Try targeting the people
    who are causing the problems.

    I'll sign it but I'll wait till I'm on my home computer so I can add a picture. Update, signed. The more I read on this Vallone guy the more this scares me. He grew up in a political family and he is doing EVERYTHING he can to keep his name in the papers.

    This is the sort that scares me the most, he wants to run at some point for higher office and he has calculated that scapegoating Pitbulls will help his political asperations.

    Don't underestimate this guy as being dumb, he is not. He's just ruthless and our dogs look like a nice step on the ladder to higher office to him.

    It has been signed, and I sent the link to a few people I know who don't come onto this site.......especially some GSD and Rottie owners I know. This kind of thing is just as important to them, they know if it works on getting our dogs banned, theirs are next! We need to reach out to the dog owning community as a whole and stand together. Yes, some of them dislike our dogs and don't realize the importance of this issue, but we still need to try. I will also crosspost this on some other forums if it hasn't already been done.
